Terms and Conditions

These Terms and Conditions (“Terms”) govern your access to and use of the Kastle Wallet (the “Wallet”), a non-custodial digital-asset wallet operated by Forbole Technology Limited, a company incorporated in Hong Kong (Company No. 3282304) with its registered office at 7/F, Cheung Hing Industrial Centre, 12P Smithfield, Kennedy Town, Hong Kong (“Forbole”, “we”, “us”, or “our”).

By using the Wallet, you (“you”, “user”) agree to be legally bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Wallet.

1. Nature of the Wallet and Non-Custodial Services

1.1 Non-Custodial Architecture. Kastle Wallet is a non-custodial software interface that enables users to interact directly with supported blockchain networks. We do not host, store, transfer, control, or have access to your digital assets or private keys. You alone control your seed phrase, private keys, and devices. We cannot recover lost keys, reverse on-chain transactions, or access your funds.

1.2 No Custody or Fiduciary Relationship. The Wallet does not create a custodial, fiduciary, trust, or other special relationship between you and Forbole. You remain solely responsible for the security and backup of your private keys, seed phrase, and devices.

1.3 Supported Networks. The Wallet supports selected blockchain networks and their tokens, including the Kaspa network and related Layer-2 networks. We may enable or disable specific networks or features at any time.

1.4 Updates and Changes. We may modify, suspend, or discontinue parts of the Wallet, or introduce new features. We will use commercially reasonable efforts to give advance notice where feasible.

1.5 Backup Obligation.

You must promptly back up your seed phrase or private key immediately after creating a wallet. Your seed phrase and private key are the only means to recover or access your digital assets if your device is lost, damaged, or the application becomes inaccessible. Forbole cannot retrieve or regenerate these credentials, and failure to securely back them up may result in permanent loss of your digital assets.

2. Eligibility and Account Use

2.1 You represent that you are of legal age and have full capacity to enter into these Terms.

2.2 You may not use the Wallet if you are a resident of, or located in, any jurisdiction subject to comprehensive sanctions or where the use of such software is prohibited by law. You represent that your use of the Wallet complies with the laws of your jurisdiction and, where applicable, the laws of the Hong Kong Special Administrative Region.

2.3 You are solely responsible for the configuration and security of your devices, operating systems, and networks used to access the Wallet.

3. Fees

3.1 Standard Fees. The Wallet may be provided free or with optional paid features. Any applicable fees, taxes, or third-party network fees (such as blockchain transaction fees) are your sole responsibility.

3.2 Swap and Transaction Fees. When you use the Swap or Bridge features within the Wallet, we may charge a service fee (a “Service Fee”) which is calculated as a percentage of the transaction amount. This Service Fee is in addition to the network gas fees and any fees charged by third-party liquidity or bridge providers. The applicable Service Fee will be displayed to you prior to your confirmation of the transaction.

3.3 Non-Refundable. Where fees are charged, they are payable in advance and are non-refundable, unless otherwise required by law.

3.4 Changes. We may change fee structures with prior notice through the Wallet interface or our official website.

4. Token Swaps, Bridges, and Third-Party Integrations

4.1 Aggregator Service Only. The Wallet may include a “Swap” or “Bridge” feature that allows you to exchange one digital asset for another or move assets between different blockchain layers (e.g., KAS L1 to Kasplex L2). You acknowledge that the Wallet acts solely as a user interface and aggregator. We do not operate a digital asset exchange or bridge protocol, we do not maintain an order book, and we do not provide liquidity. All Swaps and Bridges are routed through third-party decentralized exchanges (DEXs), cross-chain bridges, or market makers (“Third-Party Providers”).

4.2 Not a Counterparty. Forbole is not a counterparty to any Swap or Bridge transaction you execute. We do not buy or sell digital assets from or to you. Your transaction is strictly between you and the Third-Party Provider or smart contract.

4.3 Quotes and Slippage. Any exchange rates, quotes, or estimated gas fees displayed in the Wallet are estimates provided by Third-Party Providers. We do not guarantee the accuracy of these quotes. You acknowledge that the final executed price may differ from the quoted price due to “slippage” (market price movements between the time a quote is given and the time the transaction is confirmed on the blockchain).

4.4 Failed Transactions. Swaps and Bridges may fail due to insufficient network fees (“gas”), lack of liquidity, or parameters set by Third-Party Providers. You remain responsible for all network fees incurred, even if the transaction fails.

5. Acceptable Use

You agree not to misuse the Wallet or assist others to do so. In particular, you must not:

- Use the Wallet for unlawful activities or to violate sanctions;

- Interfere with, damage, or disrupt the Wallet or underlying infrastructure;

- Attempt to gain unauthorised access to systems or data;

- Upload or distribute malicious code;

- Reverse engineer, decompile, or copy proprietary portions of the Wallet except as permitted by law;

- Misrepresent or conceal the origin of your transactions.

6. Assumption of Risk

6.1 Blockchain Risk. You acknowledge that blockchain transactions are irreversible and inherently risky. You assume all risks associated with:

  • Loss or theft of private keys or seed phrases;
  • Smart-contract bugs, chain reorganisations, network congestion, or halts;
  • Miner-extractable value (MEV) and mempool behaviour;
  • Protocol or validator failures; and
  • Third-party wallet, bridge, or dApp integrations.

6.2 Swap and Bridge Specific Risks. In addition to general blockchain risks, using Swap and Bridge features involves specific risks including but not limited to:

(a) high price volatility causing significant slippage;

(b) the risk of front-running or “sandwich attacks” by bots;

(c) smart contract vulnerabilities in the Third-Party DEXs or bridges used; and

(d) the total loss of assets in the event of a bridge protocol failure or exploit.

6.3 No Control Over Networks. Forbole does not operate or control the Kaspa network or any other blockchain protocol. These networks may change their operation, rules, or consensus mechanisms without notice.

6.4 No Advice or Insurance. The Wallet provides technological functionality only and does not constitute financial, legal, or investment advice. The Wallet is not insured against digital-asset losses of any kind.

7. Intellectual Property

7.1 All intellectual-property rights in the Wallet and related content belong to Forbole or its licensors.

7.2 You receive a personal, revocable, non-exclusive, non-transferable, worldwide licence to use the Wallet solely for lawful personal or business purposes under these Terms.

7.3 You may not reproduce, modify, distribute, or create derivative works based on the Wallet without our prior written consent.

8. Termination

8.1 You may stop using the Wallet at any time.

8.2 We may suspend or terminate your access immediately if we reasonably believe you have violated these Terms, applicable laws, or our rights.

8.3 Termination will not affect accrued rights or obligations. Sections concerning disclaimers, limitations of liability, indemnity, and dispute resolution survive termination.

9. Indemnity

You agree to indemnify and hold harmless Forbole and its affiliates from all claims, losses, and liabilities arising out of your use or misuse of the Wallet or your violation of these Terms.

10.1 “As Is” Basis. The Wallet is provided on an “as is” basis. Use is at your own risk.

10.2 Software Defects and Bugs. Forbole disclaims liability for any loss of digital assets resulting from software defects, provided that Forbole did not act with gross negligence or wilful misconduct. You acknowledge that as non-custodial software, the Wallet relies on complex systems that may behave unpredictably.

10.3 Limitation of Liability. To the maximum extent permitted by law, Forbole’s aggregate liability for any claim arising out of the Wallet will not exceed the greater of US $100.

11. Governing Law and Dispute Resolution

11.1 Governing Law. These Terms are governed by the laws of the Hong Kong Special Administrative Region.

11.2 Dispute Resolution. Any dispute will be finally resolved by arbitration administered by the Hong Kong International Arbitration Centre (HKIAC) under the HKIAC Administered Arbitration Rules in force at the time. Seat: Hong Kong. Language: English.
